Thank you for choosing KOMEHYO's Ship to Us Service. These Terms and Conditions ("Terms") govern your participation in the program and the submission of any item(s) to KOMEHYO for evaluation and potential purchase. By using the Ship to Us Service and sending items to KOMEHYO, you ("Seller") agree to be bound by these Terms.
1. Preliminary Estimates and Final Valuation
Preliminary Estimates: Any quote, estimate, or valuation provided by KOMEHYO via email, website, telephone, or any other communication method prior to physical inspection of an item is provided solely for informational purposes, is non-binding, and should be considered preliminary in nature.
Final Valuation: All items submitted through the Ship to Us Service are subject to physical inspection, authentication, and evaluation by KOMEHYO's expert appraisers. The final purchase offer, if any, will be determined only after such inspection and evaluation of the item's condition, authenticity, and current market value.
The final purchase offer may differ from any preliminary estimate previously provided. KOMEHYO reserves the right to adjust, revise, or withdraw any preliminary estimate or proposed offer based on the results of its inspection, authentication, and evaluation process.
2. Identity Verification
To comply with applicable federal, state, and local laws and regulations, including anti-money laundering and secondhand dealer requirements, Seller must provide a valid government-issued photo identification upon request.
KOMEHYO may require additional information or documentation to verify Seller's identity and to conduct compliance screening as required by applicable law or KOMEHYO's internal compliance policies.
KOMEHYO reserves the right to decline or terminate a transaction if required by applicable law or if the transaction does not satisfy KOMEHYO's compliance requirements.
3. Payment
If Seller accepts KOMEHYO's final purchase offer and all applicable requirements have been satisfied, payment will be made by ACH transfer or wire transfer to an account designated by Seller.
KOMEHYO reserves the right to request reasonable documentation necessary to process payment.
4. Shipping Requirements and Risk of Loss
To participate in the Ship to Us Service, Seller must comply with all shipping instructions provided by KOMEHYO, including packaging, documentation, photography, and carrier requirements.
Seller shall comply with the following shipping requirements:
- Dimensions and Weight Verification. Seller must accurately measure and provide the final shipment dimensions and weight. Such information is required for proper shipping label generation, insurance coverage, and logistics processing.
- Pre-Shipment Photography. Seller must take clear and legible photographs of the item(s) after they have been fully packed for shipment, including photographs showing the packaging condition and protective materials used.
- Shipping Documentation. Seller must complete and sign any authorization, declaration, or other shipping-related documents required by KOMEHYO prior to or in connection with shipment.
- Carrier Drop-Off Receipt. Seller must obtain and retain the carrier drop-off receipt when tendering the package to the designated carrier. The drop-off receipt shall serve as proof that the package was transferred to the carrier for shipment.
- Shipping Deadline. Seller must deliver the package to the designated carrier within seven (7) calendar days after KOMEHYO issues the shipping label.
Provided Seller fully complies with all shipping instructions and requirements established by KOMEHYO, the shipment may be covered against loss, theft, or damage occurring during transit. Any coverage shall be subject to applicable carrier and insurance requirements, exclusions, limitations, and claim procedures.
Failure to comply with any required shipping procedures may result in denial of shipping coverage, and any resulting loss, damage, or claim may become the responsibility of Seller.
5. Acceptance of Offer and Transfer of Ownership
A binding purchase transaction is formed when:
(a) KOMEHYO issues a final purchase offer;
(b) Seller accepts that offer; and
(c) all required identity verification procedures have been completed.
Upon completion of the foregoing, ownership and title to the purchased item shall transfer to KOMEHYO, and the transaction shall become final and non-cancellable except as otherwise provided in these Terms or required by applicable law.
6. Seller Representations and Item Eligibility
Seller represents and warrants that Seller is the lawful owner of the item(s), has the full legal right and authority to sell and transfer the item(s) to KOMEHYO, that the item(s) were lawfully acquired, are free and clear of any lien, security interest, encumbrance, or ownership claim of any third party, and that all information and documentation provided to KOMEHYO in connection with the transaction are true, accurate, and complete.
Seller further acknowledges that all items are subject to authentication and review by KOMEHYO.
If KOMEHYO determines that an item cannot be purchased for any reason, including concerns regarding authenticity, condition, legal compliance, provenance, or eligibility under KOMEHYO's purchasing standards, KOMEHYO may decline to purchase the item.
In such event, KOMEHYO will return the item to Seller and will bear the cost of return shipping.
If an item is determined to be counterfeit, stolen, unlawfully obtained, or otherwise prohibited by law, KOMEHYO reserves the right to take any action required or permitted by applicable law, including cooperation with law enforcement authorities or applicable rights holders.
7. Privacy
Personal information collected in connection with the Ship to Us Service, including identification and payment information, will be collected, used, stored, and protected in accordance with the KOMEHYO Privacy Policy, which is incorporated into these Terms by reference.
8. Governing Law and Jurisdiction
These Terms and any dispute arising out of or relating to the Ship to Us Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
The parties agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in New York, New York, and each party irrevocably submits to the jurisdiction of such courts.
9. Modification of Terms
KOMEHYO reserves the right to modify these Terms from time to time. Any revised Terms will apply to future submissions made after the effective date of such revision.
