Our Commitment to Eradicating Counterfeit Items in the Secondary Market
KOMEHYO USA Inc. ("we," "us," "our") obtains all necessary Secondhand Dealer Licenses required in the jurisdictions in which we operate, and strictly adheres to all the obligations for business operators stipulated by such licenses.
As a member of the Association Against Counterfeiting Distribution (AACD) in Japan, an industry organization dedicated to eliminating counterfeit products, we take the issue of counterfeit goods in the secondary market seriously and are actively engaged in their eradication. In close collaboration with Japanese regulatory authorities, we rigorously implement a comprehensive strategy that includes a strict in-house authentication process based on our specialized expertise cultivated in Japan over many years.
The brands sold by Komehyo are not partners of or affiliated with Komehyo and do not sponsor, endorse, or participate in Komehyo’s authentication process. As such, the brands sold by Komehyo are not liable for any products found to be non-genuine or otherwise not in conformity with Komehyo’s Certificate of Authenticity.
Rigorous Authentication Process
To be a trusted marketplace for our customers, we conduct a rigorous authentication process that combines advanced technology with deep expertise. We utilize the vast appraisal data from our Japanese group company, KOMEHYO, which appraises over 2.4 million items annually,combined with an AI-powered authentication solution to perform our authentication.
Our authentication specialists are trained in the specific brands they examine. Each item we sell must pass a multi-staged inspection process which begins when each item is considered for purchase by Komehyo. Before each item is approved for resale, our authentication specialists not only inspect each item for authenticity, but they also detail and document each item’s quality, condition, and identifying information such as serial numbers.Komehyo provides its customers with all authentication and identifying information, on a per-SKU (Stock Keeping Unit) basis for each item.
Only trusted items that have cleared these thorough checks by our specialists are delivered to our customers.
Transparency and Warranty
We value transparency in our authentication process. We maintain records of when, how, and by whom each item was authenticated. Any specific notes about an item's condition, such as a missing serial number or potential repairs, will be explicitly disclosed, along with any impact on the price.
Each item approved for sale by Komehyo receives a Certificate of Authenticity as our warranty that the item is authentic and consistent with the information in the certificate. This certificate specifies information unique to the item—such as brand name, item name, and serial number. Komehyo’s Certificate of Authenticity is our guarantee that each item purchase from Komehyo has undergone our rigorous authentication process and meets our strict standards. Komehyo’s Certificate of Authenticity is backed by our promise to refund 100% of the purchase price if any item is proven not to conform with the information in the certificate.
Policy and Limited Warranty for Non-Conformity with the Certificate of Authenticity
In the unlikely event that an item sold by us is found not to conform to the Certificate of Authenticity issued by us, your sole and exclusive remedy is as set forth in this policy, subject to the following conditions.
● Exclusive Remedy: We will provide, at our option, either (a) a full refund of the purchase price or (b) replacement with a comparable authentic item (if available).
● Conditions for Remedy: To be eligible for this remedy, the following conditions must be met:
○ The original Certificate of Authenticity issued by us must be presented and returned.
○ All original accessories included at the time of sale must be returned.
○ The item must be returned to us in the same condition as at the time of sale, without any damage, modification, or alteration in any way.
● Warranty Period: This warranty is valid for a period of one (1) year from the date of purchase.
DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
THE EXPRESS WARRANTY OF AUTHENTICITY DESCRIBED ABOVE IS THE ONLY WARRANTY MADE BY US WITH RESPECT TO THE ITEMS. EXCEPT FOR THIS EXPRESS WARRANTY STATED HEREIN, WE DISCLAIM ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
THE REMEDY SET FORTH IN THIS POLICY SHALL BE THE CUSTOMER'S SOLE AND EXCLUSIVE REMEDY FOR ANY CLAIM REGARDING A BREACH OF THIS WARRANTY. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE PURCHASE PRICE PAID FOR THE ITEM AT ISSUE.
